California is a no-fault divorce state. This means that you can get a divorce (or "dissolution of marriage") in California if you and your spouse have irreconcilable differences.
Depending on your situation, there are many divorce options:
- Legal separation: A legal separation is similar to a divorce but you stay married for religious or tax purposes.
- Summary dissolution: If you and your spouse agree to the terms of your divorce, have been married for less than five years, do not have children or own a home, have less than $25,000 in property and less than $5,000 in debt and spousal support (alimony) is not an issue, you can go through a simpler divorce process that will keep you out of court and require less paperwork.
- Divorce mediation: In divorce mediation, you, your spouse and your attorneys can sit down with a negotiator with the goal of reaching a non-adversarial agreement on divorce issues.
- Divorce court: Many divorces end up in court, where a judge decides property division, spousal support, child support and custody and other divorce issues. Divorce court is the best option when couples cannot agree or there is a temporary restraining order.
